Article 1 — Scope.
These Terms govern all electrical services (installation, maintenance, repair, inspection) provided by Electr, [legal form], SIRET [to be completed], to any Client. By accepting a Quote, the Client accepts these Terms in full. Any conflicting terms from the Client are excluded unless expressly agreed in writing.
Article 2 — Quotes and Acceptance.
Quotes are free and valid for 30 days. A contract is formed upon the Client's written or signed acceptance. Any work not included in the Quote requires a separate written estimate and prior Client approval.
Article 3 — Prices and Payment.
Prices are in Euros, VAT excluded unless stated otherwise. Reduced VAT rates (10% or 5.5%) may apply for renovation works on residential properties over two years old per the French Tax Code. A 30% deposit is due upon acceptance, with the balance due within 30 days of the final invoice. Late payments incur interest at three times the legal rate plus a €40 fixed recovery fee per invoice (Art. L.441-10 and D.441-5 French Commercial Code).
Article 4 — Performance.
Electr performs all services with due care, in compliance with French electrical standards (NF C 15-100). Timelines in Quotes are estimates unless designated as firm deadlines. The Client must provide safe access, clear the work area, supply necessary authorisations, and disclose any known hazards (asbestos, lead, structural issues).
Article 5 — Acceptance.
Upon completion, the Client inspects and signs an acceptance report. Defects must be noted in writing. Without written reservations within 8 days, the work is deemed accepted.
Article 6 — Warranties.
French legal warranties apply: garantie de parfait achèvement (1 year, Art. 1792-6 Civil Code), garantie biennale for dissociable equipment (2 years, Art. 1792-3), and garantie décennale for structural work (10 years, Art. 1792). Electr holds professional liability and décennale insurance with [insurer to be completed], certificates available on request.
Article 7 — Liability.
Electr's liability is limited to direct damages from proven contractual breaches. Electr is not liable for indirect damages (loss of profit, business loss) or for issues caused by the Client's contrary instructions, unauthorised modifications, normal wear, force majeure, or third-party interventions.
Article 8 — Cancellation.
Consumer Clients contracting at a distance or off-premises have a 14-day withdrawal right (Art. L.221-18 French Consumer Code), except once Services are fully performed with prior express consent. Cancellation after this period requires written notice and reimbursement of costs incurred plus a cancellation fee of [%] of the remaining contract value.
Article 9 — Force Majeure.
Neither party is liable for non-performance due to force majeure (Art. 1218 Civil Code), including natural disasters, epidemics, strikes, or severe weather. If the event persists beyond 90 days, either party may terminate without liability.
Article 10 — Disputes.
Parties shall first attempt amicable resolution. Article 11 — Miscellaneous.
